Murad Class Action Alleges Company’s Products Unsafe for Use Around Eyes Due to Color Additives

Murad is facing a class action lawsuit that alleges the cosmetics company is concealing from customers that several of its skincare products contain color additives that are harmful when used around the eyes despite having no such warnings. . In fact, Murad asks consumers to use the product directly on or around the eyes in several cases.

The lead plaintiffs in the class action lawsuit against Murad are Jessica DeCoursey and Grace Sit. DeCoursey had red, irritated eyes that developed discharge and started swelling and tearing after using Murad Retinol Youth Renewal Eye Serum. She tried to call Murad to find out more about the product’s ingredients, but was “unable to reach an employee,” according to the complaint. DeCoursey also used the Retinol Youth Renewal Serum which brought tears to her eyes.

Plaintiff Sit relied on product labels and disclosures before purchasing Murad’s Retinol Youth Renewal Night Cream and Oil-Free Clarifying Water Gel.

“Nowhere on the labels did [Murad] disclose that the products are not to be used around the eyes,” the class action lawsuit states about Sit and DeCoursey’s experiences.

DeCoursey and Sit seek to represent a national category of all persons who purchased one or more of Murad’s allegedly affected products for personal/household use within any applicable limitation period, as well as similar New York State subcategories. and Missouri.

Murad Class Action Claims FDA Bans Certain Color Additives in Eye Cosmetics

Products that allegedly contain the color additives include Retinol Youth Eye Serum, Retinol Youth Renewal Night Cream, Retinol Youth Renewal Serum, Nutrient-Loaded Water Gel, Clarifying Water Gel, and Toner moisturizing. The color additives that can be found are FD&C Red No. 4, D&C Red No. 33 and D&C Orange No. 4.

The U.S. Food and Drug Administration (FDA) prohibits the above color additives in cosmetics intended for use around the eyes “unless specifically authorized for such use by regulation,” according to reports. court documents.

Murad “knew or should have known” that the products were unsafe for use around the eyes and deliberately and willfully misled consumers, the complaint states.

Court documents also show examples of Murad’s competitors not containing the harmful color additives or ordering consumers to keep the product out of sight.
